All works created by Claudia Malecka are protected by copyright and remain under her authorship. This covers photography, film, creative direction, concepts, and any other creative output.
Authorship & Usage
Claudia Malecka retains full authorship of all works. Clients are granted usage rights only for the purposes agreed in advance (e.g., campaigns, social media, print). Any additional use requires written agreement.
Creative Freedom & Credit
The artist retains the right to showcase and submit works to festivals, exhibitions, and competitions at any time. Whenever published, a visible and appropriate credit must be given exactly as specified by the author
Delivery
Delivery usually takes place within 14 days for photo projects. For film projects, timelines depend on post-production complexity and the editing agreed upon in advance. In case of illness, workload, or unforeseen circumstances, delivery may take longer – but never beyond 60 days from full payment.
Production Days & Overtime
A production day includes up to 10 hours. Overtime is subject to surcharges. Travel days are billed at 50% of the daily rate. Work on weekends, nights, or public holidays may also involve surcharges.
Cancellations
Confirmed bookings are binding. Deposits and part-payments are non-refundable. If a project is cancelled by the client, cancellation fees apply depending on the timing (20% to 100% of the agreed fee).
Raw Material
Unedited files (RAW images, uncut footage, project files) remain with the creator and are not part of the delivery, unless otherwise agreed in writing.
Changes by Clients
Delivered works may not be altered, re-edited, or modified by clients or third parties without prior written permission.
Portfolio & References
The artist may use commissioned works for her own portfolio, website, social media, or presentations, unless agreed otherwise beforehand.
Liability
No responsibility is taken for indirect damages, lost profits, or delays caused by force majeure, technical issues, or unforeseen events.
Legal Framework
These terms are subject to German law. Place of jurisdiction is Berlin.
Artists’ Social Contribution
Fees may be subject to the German Artists’ Social Security Contribution (Künstlersozialabgabe). Responsibility for declaration and payment lies with the client. The contribution must not be deducted from the agreed fee.
